Terms of Service

1. Acceptance of Terms

By accessing or using Scanmint (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Aayla Secura LLC (doing business as Sarvixo), the operator of Scanmint.

2. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Scanmint for your personal or internal business purposes. You may not sublicense, sell, resell, or otherwise exploit any portion of the Service without our prior written consent.

Static QR codes you generate and download are yours to use without restriction. Dynamic QR codes remain active and trackable only while your account subscription is in good standing.

3. Acceptable Use

You agree not to use the Service to:

• Point any dynamic QR code destination to content that is unlawful, malicious, phishing-related, or designed to deceive or defraud users.
• Distribute malware, spyware, adware, or other harmful software via QR redirect.
• Violate any applicable law or regulation, including export control and privacy laws.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated means to generate QR codes at volumes that place unreasonable load on our infrastructure.
• Infringe on the intellectual property rights of any third party.

We reserve the right to disable any dynamic QR code or suspend any account that we determine, in our sole discretion, is being used in violation of these Terms.

4. Accounts and Registration

Certain features (dynamic QR codes, scan analytics) require you to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate and current information during registration and keep it updated.

5. Subscriptions, Payment, and Refunds

Paid plans are billed on a recurring basis (monthly or annually, as selected) through our payment processor, Stripe. By subscribing, you authorize us to charge the payment method on file at each renewal.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period; you will not be charged for the next cycle. We do not provide prorated refunds for unused time in a paid period except where required by applicable law.

We may change subscription pricing with at least 30 days’ notice. Continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

6. Intellectual Property

All rights, title, and interest in and to the Service, including the Scanmint name, logo, software, and design, are and remain the exclusive property of Aayla Secura LLC (dba Sarvixo). Nothing in these Terms grants you any right to use our trademarks, service marks, or trade names.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AAYLA SECURA LLC (DBA SARVIXO), ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. We will notify registered users of material changes via the email address on file. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
